PSA ~ IMAGES in the PUBLIC DOMAIN

Four or five times now, i have seen where a blog contains some verbiage like:

"All images were found on the internet and assumed in the public domain"

Just an FYI kids, as of 1978, images/photos do not enter Public Domain until 70 years after the death of the original creator. Barring some written document, where the creator gives his work to the Public Domain, 

So now, ignorance to public domain is not an excuse to infringe on some creators copyright.

To break it down for you even further, the earliest that an image could be in the “public domain” on the internet (barring a specific grant by the creator giving the work to the public domain) is 2048. Images created before 1978 might be in the public domain. However, the creation of a digital file from the original analog image would be a derivative work and the digitized version would be subject to copyright.

What that means in practical terms is that “public domain” images on the internet are, in fact, a rarity. The assumption should be that all images encountered on the internet are subject to copyright. So, if you choose to post an image to your blog without crediting the author, you risk being hit with a copyright infringement suit.

Upcoming Interview on Blog+

Dan Hostettler, a professional photographer based in the Czech Republic, runs an interesting blog on glamour and nude photography. Besides educational posts on various aspects of nude photography, Dan has done a series of blog posts in which he interviews photographers who shoot nudes.
